# A damage claim weeks after you returned the rental car: is it too late for the company?

> There is no single EU deadline for a rental company to send a damage claim, so a claim weeks later can still be sent. But the later it comes, the more the company has to show that the damage happened during your rental and not afterwards. Ask when and where the car was inspected, compare that with your return time and your photos, and object in writing.

Your holiday ended a month ago. Then a letter or an email arrives, or you simply see a charge on your credit card: damage to the rental car. ==A late claim is not automatically invalid, but the delay weakens the link between the damage and your rental.== This article explains why claims arrive late and how to use the timing in your answer.

## Why claims often arrive late

ECC Finland calls it post-billing: the company issues charges after the rental for damage it believes the renter caused, often for repair costs, and charges the card after the rental has ended. It notes that many consumers are surprised by this and advises checking your card balance regularly after a rental.

Common reasons for the delay:

- the car was returned out of hours and inspected the next day or later;
- the company waited for a repair quote or invoice;
- the claim was handled by a central office or an external claims handler;
- a fine or toll arrived later and was passed on with a fee.

The Austrian ECC noted in 2026 that many companies require the card to stay valid for at least six months after the rental, to cover later charges for damage or fines. That tells you how long companies expect such charges to keep coming.

## The timing is part of the evidence

ECC-Net warns that cars returned after hours are usually inspected the next day, and that consumers can be charged with damage at a later stage. The gap between your return and the inspection matters: in that time the car may be moved, parked next to other cars or even rented again.

Ask yourself three questions:

1. **When did you hand the car back?** Look at your return form, your photos and your email.
2. **When did the company inspect it?** Ask for the time and the inspection report.
3. **Was the car used in between?** Ask whether it was rented to someone else before the damage was recorded.

If the inspection was days after your return, or after another rental, that is a strong point in your objection.

## 1. Collect your own file first

Before you answer, gather:

- the rental contract and the pick-up report;
- the return form, if you have one;
- your photos and video from pick-up and return;
- fuel receipts, toll receipts and your card statements.

The Czech ECC described a consumer who was told at return that nothing was owed, after which more than 10,000 Czech crowns was blocked on his card for damage that was not recorded at handover. His dated, geotagged pick-up photos showed the same scratches, and he argued that the burden of proof lay with the company.

## 2. Ask for the company's evidence

Konsumentverket advises that if you are billed for damage you do not recognise, you request photos, records and receipts for the repair costs. It also states that the burden of proof rests with the hire company. In practice, ask for:

- the date, time and place of the inspection;
- photos of the damage with metadata;
- whether the car was rented again between your return and the inspection;
- the repair invoice or estimate and a breakdown of fees.

Our article on [what a damage claim should contain](https://scratchfair.com/en/knowledge/damage-claim/what-a-damage-claim-should-contain) lists what a complete claim looks like.

## 3. Object in writing, quickly

A late claim does not give you more time. If money was taken from your card, chargeback deadlines run from the transaction date. Write to the company the same week, and check your card deadline with the [deadline calculator](https://scratchfair.com/en/tools/deadlines).

> [!WARNING]
> Do not ignore a late claim because it feels unfair. An unanswered claim can be passed to a debt collector. A short written objection keeps your position clear. See [what to do if a debt collector contacts you](https://scratchfair.com/en/knowledge/dispute/debt-collector-rental-car-damage).

## 4. Use the timing in your letter

State the facts plainly:

- "I returned the car on [date] at [time]. Your inspection took place on [date]."
- "My photos at return show the [panel] without damage."
- "Please explain how you established that the damage happened during my rental."

## Key box returns are the most common case

Late claims cluster around returns without staff. If that was your situation, read [who has to prove damage after a key box return](https://scratchfair.com/en/knowledge/return/key-box-return-who-proves-damage). Your photos at the drop-off spot are the most important evidence you have.

## Next steps if the company does not move

If the company is in another EU country, Iceland or Norway, the European Consumer Centre in your country can help for free: see [how an ECC complaint works](https://scratchfair.com/en/knowledge/ecc-and-disputes/ecc-complaint-car-rental). ## FAQ

**Is there a legal time limit for a damage claim?**

Limitation periods for contract claims exist in every country, but they differ and are often long. They are not the main question in most disputes. What matters more is whether the company can show the damage happened during your rental.

**The amount was taken from my card without warning. Is that allowed?**

Your contract usually allows later charges. Konsumentverket says a company should not charge your card or deduct from a deposit for damage without giving you a chance to dispute it. Object straight away and ask your card issuer about a chargeback.

**A traffic fine arrived months after my trip. Is that the same thing?**

No. Fines come from the authorities and have their own rules and deadlines. The rental company often adds an admin fee for passing on your details. Read our article on traffic fine admin fees.
