Damage claim after renting a car in Spain: what can you do?

Common problems with rental cars in Spain flagged by the Spanish consumer authorities, and the steps to dispute a damage claim from a Spanish rental office.

The Spanish European Consumer Centre has flagged charges for minor damage or cleaning after the car was returned, sometimes checked without the customer present.

  • Object in writing, preferably in Spanish and your own language, and ask for the inspection photos and invoice.
  • If you live outside Spain, your own European Consumer Centre can help for free.

Spain is one of the most popular countries in Europe for a holiday rental car, and also a country where many travellers run into damage claims. The Spanish European Consumer Centre itself has listed the practices it sees most. Knowing them helps you prepare, and helps you object.

What the Spanish consumer authorities flagged

A document published on the website of the Spanish consumer authority, based on the work of the Spanish ECC, lists four irregular practices:

  1. Fuel policy. You pay for a full tank at pick-up and return the car empty, and unused fuel is not refunded.
  2. Online price. The final price does not include extra charges, for example for returning at another location or outside opening hours.
  3. Charges after return. Customers are billed for minor damage or cleaning after the car is returned, sometimes without being present at the inspection or without a copy of the contract.
  4. Payment. Some companies only accept credit cards and refuse debit cards and cash.

Point 3 is exactly where most damage claims come from.

Before and during the rental

  • Ask to be present at the return inspection and to have the result signed.
  • Photograph the fuel gauge and the mileage at pick-up and return.
  • Keep a copy of the contract and every form you sign.
  • Use our pick-up checklist and the evidence mode.

Fuel and insurance at the Spanish desk

Two of the four practices on the Spanish list happen at the desk, before you drive off. The fuel policy decides whether you pay for a full tank you may not use. Read full to full or full to empty before you accept a "full to empty" option. At the same desk, you may be offered extra cover to reduce the excess. Whether to buy it is your choice; see extra insurance at the rental desk for what to ask before you sign.

Spanish words you will see on the forms

Most Spanish rental paperwork uses the same terms. Knowing them makes it easier to check what you sign:

Spanish Meaning
contrato de alquiler rental contract
daños / parte de daños damage / damage report
arañazo, rayón scratch
abolladura dent
franquicia excess
fianza, depósito deposit
seguro a todo riesgo sin franquicia full cover without excess
lleno/lleno full to full
hoja de reclamaciones official complaint form

Our form translator helps with the rest of a form.

Airport returns and closed offices

Many Spanish rentals start and end at an airport, often early in the morning. If no one is there to inspect the car, the company checks it later without you. That is the situation the Spanish list describes in point 3. Take a timed video around the car, including the roof, wheels and interior, and keep the parking ticket or key box receipt. See who has to prove damage after a key box return.

A short example

You return a car at Málaga airport at 06:00, when the desk is closed, and leave the keys in the box. Three weeks later, a €300 charge appears for "cleaning and scratch rear bumper". You have a video from the parking bay, timestamped 05:52, showing a clean car and an undamaged bumper. You object in writing in Spanish and your own language, attach the video and ask for the inspection photos with date and time and the repair invoice.

On the spot: complaint forms

Consumer.es, the consumer magazine of a Spanish foundation, explains that businesses in Spain must have official complaint forms (hojas de reclamaciones) available. If you have a problem at the desk, you can ask for one. The white copy goes to the consumer authority, with your documents attached.

After you got home: object in writing

Consumer.es advises first trying to solve it with the company itself and asking for documentary proof of any charge made after you returned the car. That matches the general approach in how to dispute a damage claim:

  • object in writing, in Spanish and your own language;
  • ask for the return inspection photos with date and time, and the repair invoice;
  • give a deadline and ask them to stop collection meanwhile.

If the amount was already charged, see damage charged to your credit card.

Help if you live outside Spain

If you live in another EU country, Iceland or Norway, the European Consumer Centre in your own country can take up the complaint for free with the Spanish ECC. See how an ECC complaint works or use the ECC finder.

Consumer.es also mentions Spanish arbitration boards for transport (Juntas Arbitrales del Transporte) for claims below €15,000, unless the contract excluded them. Ask your ECC whether that route fits your case.

Frequently asked questions

Do I have to write in Spanish?

It is not required, but it helps: the local office can read your letter straight away. Scratchfair writes the letter in Spanish and in your own language.

What are 'hojas de reclamaciones'?

Official complaint forms that businesses in Spain must have available. Consumer.es explains that you hand in the white copy to the consumer authority. They are mostly useful when you are still on the spot.

The company only accepted a credit card. Is that allowed?

The Spanish consumer authority lists 'credit card only' as one of the practices it flagged. Check the conditions before you book.
