Laws and rules

The European rules behind your rights, in plain language.

Laws and rules · 4 minCan a rental company track your rental car by GPS? Privacy rules for connected cars

Many rental cars send location and vehicle data to the manufacturer or the rental company. The European Data Protection Board treats location data as high-risk: it should not be collected continuously by default, and tracking a car just in case it is stolen is not justified. As a driver, you can ask the rental company which data it holds about you under the GDPR. When you return the car, delete your phone connection and navigation history from the infotainment system.

Laws and rules · 4 minCan you cancel a rental car booking for free? The 14-day withdrawal right explained

Under the EU Consumer Rights Directive, the 14-day right of withdrawal for online purchases does not apply to car rental services booked for a specific date or period. ECC-Net confirms there is no cooling-off period for car rental. Whether you can cancel for free depends on the booking terms you accepted, such as a free-cancellation window or a prepaid, non-refundable rate. In a package holiday, different rules apply.

Laws and rules · 4 minCan you drive a rental car to another country? Cross-border rules, fees and insurance

Whether you can take a rental car across a border depends on the rental company's terms, not on EU law alone. Your Europe advises telling the company in advance which countries you plan to visit. Within the EU and some neighbouring countries, the number plate serves as proof of insurance under the green card system, but outside that area you may need a green card or border insurance. Driving into a country your contract does not allow can leave you without cover.

Laws and rules · 4 minWho has to prove damage to a rental car: you or the rental company?

Konsumentverket, the Swedish consumer agency, states that the burden of proof rests with the rental company to show you were responsible for the damage. It points to a 2019 Swedish appeal court ruling that a company cannot require payment if you can show you took proper care of the car. In practice, your own evidence still matters a lot, because a signed report or a clear photo can decide the case either way.

Laws and rules · 4 minUnfair terms in a car rental contract: what does EU law say?

Under the EU Unfair Contract Terms Directive, a standard term that, contrary to good faith, causes a significant imbalance in rights and obligations to your detriment is not binding on you. Terms must be in plain, intelligible language, and unclear terms are read in your favour. Whether a specific clause is unfair is decided case by case.
